Terms and conditions – Synsam
1. Introduction
These terms and conditions (the "Terms") apply when you access or use the Synsam website in France, Germany, Spain, Italy, Poland and the UK (the "Site"). By accessing or using the Site, you represent that you are of the age of legal majority in your jurisdiction and agree to be bound by these Terms. If you do not agree to these Terms, you shall discontinue use of the Site.
Synsam Group One AB, a company incorporated in Sweden with company reg. no. 556762-7244 ("Synsam", "we", "us" or "our") provides the online platform to showcase and promote its products on the Site. The sales on the Site are facilitated, handled and fulfilled by our e-commerce partner Global-E NL B.V., a company incorporated in the Netherlands with company reg. no. 72541466 ("Global-E"). Global-E operates independently of Synsam, and Synsam is not responsible or liable for any acts or omissions of Global-E.

2. Purchases and returns
All purchases made via the Site are sold by Global-E (or its affiliated entities), acting as the merchant of record, and are subject to Global-E's Terms of Sale (the "Terms of Sale") presented at checkout. The contract for any purchase is made between you and Global-E. Synsam is not a party to any such purchase transaction or contract.
This means that all aspects relating to any purchases you make from our Site – e.g., payment, order processing, fulfilment, delivery, returns, refunds and customer service are handled by Global-E. As such, all terms relating to payments, deliveries and returns may be found in the Terms of Sale.
Any queries you may have in relation to a purchase you have made from our Site (e.g., on order delivery, payment methods or returns) should be directed to Global-E using the contact details included in Section 12 below.
3. Pricing
Prices may include taxes and duties. Where applicable to your purchase, these will be as indicated at checkout.
4. The Site
You agree to use the Site responsibly and in accordance with these Terms. You may not: (i) use the Site in any manner that could damage or impair the Site, (ii) attempt to gain unauthorized access to any part of the Site, its servers, or any systems or networks connected to the Site, (iii) collect data from it without our prior written consent, or (iv) use the Site for fraudulent, deceptive or unlawful purposes. We reserve the right to suspend or terminate your access to the Site if we reasonably consider it necessary, including where these Terms have not been followed.
We do not guarantee that the Site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of the Site for business and operational reasons.
You are also responsible for ensuring that all persons who access the Site through your internet connection are aware of these Terms, and that they comply with them.
5. Intellectual property rights
All content on the Site that is controlled by us, such as text, graphics, logos, trademarks, images, other intellectual property rights, and compilations thereof (the "Content"), is the exclusive property of Synsam or its licensors and is protected by applicable intellectual property laws. No license or right is granted to you in relation to any Content. You may not reproduce, modify or otherwise use any Content without the prior written consent of Synsam.
6. Products on the Site
Whilst we seek to provide accurate descriptions as well as presentations of products on the Site, please note that colors in images may vary depending on your device’s display as well as device settings used by you, and so a product may appear different in person to how it appears on the Site.
7. Consumer rights
Your statutory consumer rights, including any applicable withdrawal rights in respect of purchases, are governed by the Terms of Sale and applicable mandatory law. Please direct all queries on your applicable statutory consumer rights to Global-E in accordance with the Terms of Sale. Nothing in these Terms is intended to exclude or limit any mandatory consumer protections afforded to you under the applicable law of your country of residence, to the extent such protections cannot be excluded or limited by agreement.
8. Privacy
We will process personal data when you use the Site in accordance with our Privacy Policy and our Cookie Policy. Personal data is also processed by Global-E in relation to your purchases – that personal data is processed in accordance with Global-E's privacy policy that is presented at checkout.
9. Changes
We reserve the right to amend, modify or replace these Terms at any time in our sole discretion. Changes will be effective on the date set out in the revised Terms on the Site. Please review these Terms periodically. Your continued access to or use of the Site following the posting of any changes shall constitute your binding acceptance of such changes. If you do not agree to the revised Terms, you shall discontinue the use of the Site.
In relation to changes to terms governing any purchases you make through the Site, please refer to the Terms of Sale.
10. Limitation of liability
To the furthest extent permitted under applicable law, we are not liable for any indirect, incidental or consequential damages arising out of or in connection with the Site or the subject matter of these Terms.
The above limitation does not affect rights you have as a consumer under the applicable law of your country of residence, which may include restrictions on our ability to limit our liability to you.
11. Governing law and dispute resolution
These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of Sweden. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Stockholm, Sweden. The foregoing is without prejudice to any mandatory provisions of the applicable law of your country of residence that require consumer contracts to be interpreted under local law and/or consumer disputes to be subject to the jurisdiction of local courts and that cannot be derogated from by agreement.
Please note that you may have right to use alternative dispute resolution (ADR) mechanisms or similar mechanisms under applicable law.
